We do not sell, rent, share, or transfer your personal information or your customers' information to third parties for marketing purposes. We do not use your data to train AI models for other companies. We do not share data with affiliates or data brokers.

Third-Party Service Providers

We use trusted third-party platforms to deliver our services, including GoHighLevel (CRM and automation), Twilio (voice and SMS infrastructure), and Square (payment processing). These providers receive only the data necessary to perform their functions and are bound by their own privacy policies and applicable law.

Data Retention

Call recordings and transcripts are retained for a minimum of four years in compliance with FCC recordkeeping requirements. You may request deletion of your data at any time by contacting us at dukesaiagents@gmail.com.

Your Rights

You have the right to request access to, correction of, or deletion of your personal data. Kansas residents and residents of other states with applicable privacy laws may have additional rights. Contact us to exercise any of these rights.

We use industry-standard security measures to protect your data. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Terms of Service

Agreement

By using Duke's AI services or submitting our request form, you agree to these Terms of Service. If you do not agree, do not use our services.

Services Provided

Duke's AI provides custom AI-powered inbound voice receptionist services for small businesses, including agent configuration, call handling, transcription, and CRM integration. Services are provided on a month-to-month subscription basis following a one-time setup fee.

Setup Fee & Subscription

A one-time setup fee of $1,000 is due prior to agent build commencement. Monthly subscription fees of $197 begin on the date your agent goes live. No long-term contract is required. You may cancel at any time with 30 days written notice.

Refunds

Setup fees are non-refundable once agent build has commenced. Monthly fees are non-refundable for the current billing period. Disputes must be raised within 30 days of the charge.

Client Responsibilities

You agree to provide accurate business information for agent training, maintain active call forwarding to your AI agent number, and ensure your use of Duke's AI services complies with applicable laws including TCPA, FCC regulations, and state AI transparency requirements.

AI Disclosure Requirement

Required by law: All calls handled by Duke's AI will include a mandatory AI identity disclosure at the start of each call. You acknowledge and agree to this requirement as a condition of service. Attempting to disable or circumvent AI disclosures is not permitted and may result in service termination.

Limitation of Liability

Duke's AI is not liable for missed calls, lost business, or damages resulting from technical failures, carrier outages, or service interruptions beyond our control. Our total liability is limited to the fees paid in the 30 days preceding any claim.

Termination

Either party may terminate service with 30 days written notice. Duke's AI reserves the right to terminate service immediately for violations of these terms, non-payment, or unlawful use.

Governing Law

These terms are governed by the laws of the State of Kansas. Disputes shall be resolved in Sedgwick County, Kansas.

Changes to Terms

We may update these terms with 30 days notice. Continued use of services after notice constitutes acceptance.

SMS / Text Messaging Terms

Program Description

Duke's AI operates an SMS messaging program called "Duke's AI Messaging" to send service-related notifications to clients and callers who have opted in through our chat widget. Messages may include appointment confirmations, service reminders, account notifications, and business updates.

How to Opt In

You may opt in to receive text messages from Duke's AI by submitting your phone number through our website chat widget and providing your express consent to receive messages. Consent to receive SMS is never required to purchase our services or submit a contact form.

SMS consent is collected exclusively through the chat widget on our website. Submitting our contact or signup form does not enroll you in SMS messaging.

Message Frequency

Message frequency varies based on your service activity. You may receive appointment confirmations, call summaries, billing notifications, and occasional service updates. We will not send unsolicited marketing messages.

Message & Data Rates

Message and data rates may apply. For questions about your text plan or data plan, contact your wireless provider.

How to Opt Out

To stop receiving messages at any time, reply STOP to any message from Duke's AI. After you send STOP, we will confirm your unsubscribe via SMS. You will no longer receive messages from us after that confirmation. To rejoin, contact us at dukesaiagents@gmail.com or submit the chat widget again.

AI Voice Agent Disclosures

AI Identity

All voice calls handled by Duke's AI systems begin with a clear disclosure that the caller is speaking with an AI-powered automated assistant. Duke's AI never impersonates a human employee or representative.

Call Recording

Callers are notified at the beginning of each call that the conversation may be recorded for business and quality purposes. Kansas is a one-party consent state; we notify all callers as a best practice and to comply with applicable multi-state requirements.

Opt-Out

Any caller may request to speak with a human representative or disengage from the AI at any time during a call. All calls include a clear escalation path.

Inbound Only

Duke's AI provides inbound call answering services only. We do not initiate unsolicited outbound automated calls on behalf of our clients.

Compliance

Services are provided in compliance with FTC guidelines, FCC regulations, Kansas state law, the California AI Transparency Act (SB 942) for covered interactions, and all other applicable 2026 AI and telecommunications regulations.
